Elder Abuse

The Ben Law Firm advocates for victims of elder abuse in South Florida. Elder abuse occurs when a person mistreats someone 65 years of age or older. This mistreatment may take the form of physical abuse, sexual abuse, emotional abuse or financial abuse.

Physical abuse occurs when the abuser inflicts physical pain or injury on an elderly person, such as if a nurse hits or kicks an elder. Emotional abuse occurs when an abuser humiliates, intimidates or threatens the elder. Financial abuse occurs when an abuser uses an elder's financial resources without consent and for the benefit of another. Experts estimate that 5 million cases of financial or material exploitation of the elderly occur each year.

While overt mistreatment of the elderly does occur, elder abuse more often appears in the form of neglect, such as if a caretaker fails to provide the elder with food, healthcare and other basic necessities. Neglect also includes elder abandonment.
